SWEEPSTAKES OFFICIAL RULES 

NO PURCHASE NECESSARY TO ENTER OR WIN, NOR WILL PURCHASE INCREASE YOUR CHANCES OF WINNING. 

1. SPONSOR.  

This random drawing sweepstakes (the “Sweepstakes”) is sponsored by Clean Beauty Collaborative, Inc., 5885 Hollis Street, Suite 100, Emeryville, CA  94608 (the “Sponsor”). The Sweepstakes is not endorsed by or associated with the social media providers or other digital platforms or various media formats used to distribute information regarding the opportunity to enter the Sweepstakes.

2. CONTEST PERIOD. 

The Sweepstakes begins Tuesday, October 3, 2023 at 9:00 a.m. Pacific Time (“PT”) and ends on Friday, November 3, 2023 at 9:00 a.m. PT (the “Promotion Period”). All federal, state and local laws and regulations apply. Void outside of the United States and/or wherever else prohibited or restricted by law.  Immediately upon submission, all entries become the property of Sponsor and will neither be acknowledged nor returned other than as herein described. 

 3. AGREEMENT TO RULES.

By entering, each participant (the “Participant”) acknowledges acceptance of and compliance with these official rules (the “Official Rules”) and represents and warrants that Participant meets the eligibility requirements set forth herein. In addition, Participant agrees to accept the decisions of Sponsor as final and binding as it relates to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein. 

 4. ELIGIBILITY. 

Sweepstakes is open to all legal residents of the fifty (50) US states who are at least eighteen (18) years of age at time of entry.  Any entrants found to be under the age of 18 shall be disqualified. Employees of Amyris, Inc., the Sponsor, its related or affiliated entities, or the advertising and promotion agencies involved in the Sweepstakes, and each of their respective employees (collectively, “Promotion Parties”), and their immediate family members (parent, child, sibling and spouse of each, regardless of where they reside) and those living in the same households of each (whether related or not) are not eligible. 

5. HOW TO ENTER: 

To enter, sign up for email or email and SMS via the website popup modal (the “Entry”).  Limit one (1) Entry per person.  For purposes of this Sweepstakes, “receipt” of an Entry will be based on timestamps shown. The Entry will be deemed to be submitted by the person in whose name a legitimate Instagram account is associated at time of Entry, but only if that person meets all other eligibility criteria.  Use of fraudulent methods or other attempts to circumvent the Official Rules will result in your Entry being removed from eligibility in the sole discretion of Sponsor.   

 6. WINNING ENTRIES; NOTIFICATION:

For each prize offered, one (1) winning Entry (each a “Winner”) will be drawn at random by Sponsor on Monday, November 6, 2023 (“Drawing Date”) at approximately 12:00 p.m. PST. Odds of winning depend upon the total number of eligible Entries received in the Promotion Period. All drawings will be conducted by Sponsor, whose decisions are final on all matters relating to the Sweepstakes. 

No one is a Winner unless and until the Sponsor officially confirms him/her as a Winner in accordance with these Official Rules, even if such person is announced as the Winner or an eligible Winner. The Winner will be notified separately by means of the contact information provided at the time of Sweepstakes entry. Winner must respond to such notifications within three (3) days of receipt. Winners may be required to complete, execute and return an Affidavit of Eligibility and Release. 

If an eligible Winner cannot be contacted within 48 hours of the Sponsor’s attempted contact, or if there is a return on any notification as undeliverable and/or if any correspondence is not responded to, then the Winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit all rights to the applicable Prize) and Sponsor reserves the right, in its sole discretion and time permitting, to select an alternate eligible Winner in accordance with the applicable procedures as outlined in these Official Rules. 

7. PRIZES:

Prizes will be awarded consisting of the following items: 

• Four (4) Softlight Skin-Smoothing Liquid Foundations  
• Four (4) Softlight Luminous Hydrating Concealer  

• One (1) Number 3 Foundation Brush 
• One (1) Number 1 Concealer Brush 

The total approximate value of all prizes is $470.00. 

IMPORTANT NOTE: In the event that for any reason the prize provider or Sponsor is unable to present the prize on the specified date, the award of prizes of equivalent value will continue as planned according to the Sponsor’s sole discretion. Should any other cause beyond Sponsor’s control impact the Sweepstakes or Sponsor’s ability to award the prizes as planned such as fire, earthquake, labor disputes or strikes, acts of God, pandemic, terrorist threat or activity, or any federal, state or local government law, order or regulation, Sponsor may in its sole discretion suspend the Sweepstakes to address the impairment and them resume the Sweepstakes in a manner that best confirms to the spirit of these Official Rules.   

8. PRIZE CONDITIONS:

No transfer or substitution of any prize is allowed, except at the sole discretion of the Sponsor. The potential winner must comply with all Sweepstakes rules as published and may be asked to complete and sign and return an affidavit of eligibility and liability and publicity release, within three (3) days of the prize notification or the prize may be forfeited and an alternate winner selected. Return of prize notification as undeliverable; and/or failure to provide any other required documentation in a timely manner may result in disqualification and selection of an alternate winner. Non-winning Participants will not be notified. Winning a prize is contingent on fulfilling all the requirements set forth herein. Winner is responsible for all federal, state, and local taxes, if applicable. Winner’s Entry and acceptance of any prize constitutes permission (except where prohibited by law) for the Sponsor to use said winner’s name, photograph, likeness, statements, biographical information, voice, and address (city and state) on a worldwide basis, and in all forms of media, in perpetuity, without notice or further compensation. 

9. SWEEPSTAKES TERMS & CONDITIONS:

The Sweepstakes is subject to all applicable federal, state, and local laws. By participating, Participants agree to be bound by these Official Rules and the decisions of the Sponsor and waive any right to claim ambiguity in regard to the mechanics of the Sweepstakes or the interpretation of these Official Rules. The winner and Participants also agree to release, discharge, indemnify and hold harmless the Sponsor and Instagram, their respective affiliates and their respective directors, officers, employees and agents, from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize offered, or participation in this Sweepstakes. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Sweepstakes will be declared ineligible and may be prosecuted to the full extent of the law. Sponsor and Instagram are not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with, or utilized in, this Sweepstakes, or by any technical or human error that may occur in the processing and/or transmissions in the Sweepstakes. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of email due to technical problems or traffic congestion on the Internet or at any website or combination thereof, including injury or damage to Participants or to any other person’s computer related to, or resulting from, participating in or downloading of materials in this Sweepstakes. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, infection by computer virus, bugs, worms, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the reasonable control of the Sponsor that may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Internet portion of the  Sweepstakes, and select a winner from all entries received up to the time of termination. Any person attempting to defraud or in any way tamper with the mechanics or logistics of this Sweepstakes will be declared ineligible and may be prosecuted to the full extent of the law. This Sweepstakes is governed by the laws of the United States and the State of California, without respect to conflict of law doctrines. As a condition of participating in this Sweepstakes, entrants agree that any and all disputes and causes of action against Sponsor arising out of or in connection with this Sweepstakes shall be resolved individually (without resort to any form of class action). Such dispute shall be resolved by mediation and binding arbitration. Further, in any such dispute, under no circumstances will Participants be permitted to obtain awards for, and hereby waive all rights to claim punitive, incidental or consequential damages, including attorneys’ fees, and Participants further waive all rights to have damages multiplied or increased. 

10. WINNERS LIST:

There will be one (1) winner, and the winner’s name will be announced via email communication and other social media by the Sponsor. To receive written confirmation of the winner, mail a self-addressed stamped envelope to Sweepstakes Winner’s List Request, c/o Rose Inc. Marketing, 5885 Hollis Street, Suite 100, Emeryville, CA  94608. Requests must be received by within seven (7) days of the close of the Promotion Period. 

11. PRIVACY:

Personally identifiable information that is submitted by entrants as part of the Sweepstakes will be used to administer the Sweepstakes, select and announce the prize winner, fulfill the prizes, and will be treated in accordance with the privacy policy accessible at: https://www.roseinc.com/pages/privacy-policy.  Your Entry into the Sweepstakes constitutes acceptance of the Sponsor’s privacy policy.
